Terms and Conditions of Sale
These Terms and Conditions of Sale apply to orders placed on the e-commerce website www.preziosajewelry.com.
The website www.preziosajewelry.com (hereinafter referred to as "Preziosa Shop") is managed by Preziosa s.r.l. (hereinafter referred to as "Preziosa"), with its registered office at Via Tito Speri 1, 20154 Milan, Italy. All purchases of products made on the e-commerce platform www.preziosajewelry.com shall be governed by the following terms and conditions of sale, which the customer expressly and freely accepts before completing the purchase.
General Notes on These Terms and Conditions of Sale
These Terms and Conditions of Sale may change over time and be updated on Preziosa Shop. Any changes to the Terms and Conditions of Sale shall apply to orders placed from the effective date onwards, provided that the modified Terms and Conditions are visible on the website at the time of purchase. Before placing a product order, users will be given a reasonable opportunity to review these Terms and Conditions of Sale and will be required to accept them.
1. Personal Account Registration
Users are encouraged to create a personal user account (personal identification data or username). Users must maintain the confidentiality of their password, limit access to their password and account, and take full responsibility for all actions and purchases made through their account. This account will allow users to check their order status, wishlist, and all personal data related to past purchases. The status of personalized orders will not be visible.
2. Order Placement Procedure
To purchase products on Preziosa Shop, the following steps must be followed:
Create a registered account on Preziosa Shop;
Accept these Terms and Conditions of Sale and Preziosa Shop’s privacy policy;
Provide name, address, phone number, email address, payment details, and other required information (unless purchasing in a showroom or temporary store);
Provide a valid delivery address.
Users may place an order by proceeding to checkout after clicking the "Add to Cart" button. Users acknowledge that their order is an offer to purchase the product(s) indicated in the order under these Terms and Conditions of Sale. Each product order is considered a separate purchase. If the same user places multiple consecutive orders and wishes to receive them in a single shipment, they must contact customer service to request this service before the orders are shipped. All orders are subject to acceptance by Preziosa, which reserves the right to refuse any order (including, but not limited to, those suspected of fraud) without providing an explanation. Users will be notified if Preziosa decides not to accept an order. Users will have the opportunity to review their order(s), read and accept the Terms and Conditions of Sale, check the total price and product features, review the provided information, and correct any entry errors before confirming the order(s).
3. Order Processing
Once the order(s) have been finalized on Preziosa Shop following the online ordering procedure, Preziosa will send an email to the provided email address confirming receipt of the order(s) and listing the details of the ordered product(s) (Order Confirmation Email). This email does not constitute acceptance of the order(s); it is only a confirmation of receipt by Preziosa. The contract between the user and Preziosa is considered concluded only when Preziosa sends the user an email confirming that the product(s) has/have been shipped (Shipping Confirmation Email). Users may cancel their order within 24 hours of receiving the Order Confirmation email and only before receiving the Shipping Confirmation email by contacting Preziosa’s customer service at info@preziosajewelry.com or via phone at +39 3472752489 (call or text message).
During certain periods of the year, order processing or customization (for personalized orders) may take longer than expected (compared to the timeframes indicated on the product description page). This information will be explicitly provided to the customer before completing the order. It is at the customer’s discretion to accept the indicated timeframe or cancel the purchase. Completing the order implies acceptance of the given timeframe.
4. Prices and Shipping Costs
The price of each product is indicated at the time of purchase and may change over time. However, such changes will not affect the price of orders already placed. All products are sold at the listed prices valid at the time the order is placed. Prices are indicated in euros (€) and include VAT at 22%, but do not include shipping costs. Shipping costs are explicitly indicated during the checkout process and may vary over time. In such cases, any changes will be communicated before order confirmation. Shipping costs vary depending on the destination country. If the buyer does not accept these conditions, they may cancel the online purchase process.
The price charged for a product will be the one displayed on the product information page at the time of order placement. It will also be confirmed on the order summary page before finalizing the order and in the Order Confirmation email.
5. Payment
Payments must be made using one of the following methods selected during checkout: VISA, MasterCard, PayPal, Amazon Pay, Klarna, or bank transfer. If the payment transaction is declined by third-party payment services (Nexi for credit cards, Amazon Pay, Klarna), the order will be considered canceled, and no amount will be charged to the customer.
In the case of a bank transfer, it may take 2-3 business days to confirm the "Payment Accepted" status, which is the time needed for the payment to be credited to Preziosa’s bank account. Once the transaction is complete, Preziosa will send a confirmation email ("Payment Accepted" email) and proceed with order preparation.
6. Delivery and Shipping
Orders are shipped via DHL Italia. Shipping costs may change over time, but they will always be explicitly indicated before completing the order. Shipping costs vary depending on the destination country and do not include custom duties and taxes (we always ship from italy).
For shipments within Italy, delivery usually takes 2-3 business days, provided payment is received before 1:00 PM on the order date. The delivery will occur within 30 days from the Shipping Confirmation email. Certain remote areas and islands may require up to 5 business days.
Customers will receive a tracking code via SMS from DHL at the phone number provided during checkout. If the user delays or refuses the delivery without a valid reason, or provides an incorrect delivery address causing a failed delivery, the package will be returned to Preziosa. Preziosa will be relieved of its delivery obligation and may refund the customer after deducting shipping, storage, and return costs.
Preziosa advises customers not to accept packages that appear damaged, torn, or tampered with. If the package appears to be in poor condition, the customer should refuse delivery and immediately contact Preziosa’s customer service at info@preziosajewelry.com.
7. Product Availability
If a product is unavailable, users will be prevented from ordering it. In rare cases, a product may become unavailable after an order is placed. In such cases, Preziosa will notify the user, and the contract will not be concluded. If payment has already been made, Preziosa will refund the amount within 30 days of the notification.
8. Returns and Refunds
If a product is defective, customers must send clear photographic evidence within 24 hours of receiving the order. Preziosa will evaluate the claim and, if the defect is verified, offer a free replacement or a full refund. Personalized items, including engraved products, cannot be returned.
9. Customized Jewelry
Personalized jewelry designed using the configurator or purchased with the request for "engravings" (by selecting the "custom engraving name/date/symbol" service) is considered "MADE-TO-ORDER" under Article 45 of the Consumer Code. This article clearly defines "customized goods" as products created following “consumer specifications,” not pre-manufactured or offered as a “variant,” but rather produced based on an individual, exceptional choice or decision, specifically applied to the item by the supplier.
The Consumer Code (Legislative Decree 206/2005) states that the right of withdrawal does not apply to personalized products purchased online. More specifically, Article 59, letter s, of the Consumer Code excludes the right of withdrawal for goods made to order or clearly customized.
However, the user has the right to cancel the order within a maximum of 2 hours from order confirmation and payment, as the personalization process is always initiated immediately after order confirmation.
These orders follow a different process as they require the production of a unique piece purchased by the customer. Once production has started, the customer will no longer be able to request a refund or cancel the order. The production process begins within 2 to 3 hours after the order is received. Once this procedure has started, any cancellation request may only be accepted at the discretion of Preziosa S.r.l.
10. Personalized Jewelry and Skyline Collection Configurator
When purchasing Skyline personalized jewelry on www.preziosajewelry.com using the configurator, the user selects and customizes the jewelry with the desired elements and can view the final result through a render. The render should be considered as an indicative reference of the finished product. Preziosa may apply technical adjustments to enhance the jewelry’s quality and ensure its structural stability.
For Skyline jewelry orders with Jolly elements, Preziosa will create the model within 24 to 48 business hours and provide images for the customer’s approval. The customer must respond promptly; any delay in response will extend the production timeline. The 15-business-day timeframe for crafting the jewelry begins only after the customer has confirmed the model. Any delays due to the customer’s failure to respond will not be counted within the estimated timeline.
Production and Delivery Times
Silver jewelry: Approximately 15 business days
Plated jewelry: Approximately 20 business days
These timelines exclude weekends and holidays. While Preziosa aims to adhere to these estimates, unforeseen production delays beyond its control may occur. However, Preziosa guarantees shipment of the personalized item within a maximum of 30 business days from order confirmation (excluding delays due to the customer’s approval process). If this deadline is exceeded, the customer is entitled to a full refund.
Return & Refund Policy
All personalized items, including engravings, are non-returnable and non-refundable for any reason, as they are custom-made for the customer. The customer confirms each stage before production proceeds. Exceptions apply only in cases of evident errors or product defects, which must be reported within 3 days of receiving the item.
Intellectual Property Rights
All Skyline personalized jewelry created via the configurator remains the intellectual property of Preziosa. The designs and renders are exclusive property of Preziosa, and placing an order does not grant ownership of these rights. Jolly elements requested by customers also remain the property of Preziosa, as their design is created by the company. These elements may be added to the general selection of available components in the configurator.
Seasonal Production Delays
During certain times of the year, production and shipping may take longer than expected due to third-party delays beyond Preziosa’s control. Preziosa will make every effort to deliver as soon as possible. In such cases, the maximum estimated delivery time remains 30 business days.
12. Customized Articles and Jewelry with or without Configurator
When purchasing customized jewelry on the website www.preziosajewelry.com, the user selects the desired piece and, following the instructions, sends Preziosa a customization request via email or phone.
The user has the right to cancel the order within 24 hours of order confirmation and payment. These orders are treated differently because they involve starting the production of a single piece specifically for the customer. Once production has begun, the customer can no longer request a refund or order cancellation.
Any customized item (including engravings) cannot be returned or refunded for any reason, as it is made specifically to the customer's request, and the customer confirms each stage for production advancement. Exceptions apply only in cases of evident errors or product deformations reported by the customer within 3 days of receiving the product.
All customized jewelry remains the intellectual property of Preziosa.
During certain periods of the year, the production of customized orders may take longer than the estimated time indicated on the product page. This information will be explicitly provided to the customer before finalizing the order. It is at the customer’s discretion to complete the purchase by accepting the indicated timeline or cancel the procedure. Completing the order implies acceptance of the production timeline.
Returns
Returns of products purchased on www.preziosajewelry.com are not free, except under the conditions specified in section 9. Returns for size, model, or color exchange are always possible but at the customer’s expense. Returned products must be new and unworn, and return requests must be made within 30 days. Preziosa offers two return options:
RETURN AND SHIPPING: The shipping cost (which varies depending on the destination country) is calculated for both routes, plus an additional €10 for the service.
For example, Germany has a shipping cost of €25 per route. To process the return, including shipping, you will need to pay €25 + €25 + €10, for a total of €60.
CUSTOMER-PAID RETURN AND SHIPPING: Costs the shipping cost (which varies depending on the destination country) includes an additional €10 for the return service. The customer can return the product at their own expense using a traceable courier. Preziosa will then ship the new item only after receiving the return.
Warranties and Legal Rights
The user is covered by a legal warranty for purchased items found to be defective. In such cases, the user may:
Request a remedy (correction of the defect or replacement with a defect-free item, at their discretion, unless correction or replacement is not feasible or reasonable).
If no remedy is possible, terminate the contract or request a price reduction.
The user cannot dispute if:
The item is suitable for its intended use as per the contract.
The item is of standard quality expected for such items, given the type of product.
If Preziosa provides a defect-free replacement, the defective item must be returned.
Users must report defects as soon as they are discovered. Reports made within two months of discovery are considered timely. Legal claims for non-conformity expire two years from the complaint unless the user requests a price reduction or damages.
Users should keep their order confirmation, invoice, or receipt as proof of purchase.
13. Intellectual Property and Rights
The website and all its content (images, photos, texts, logos, icons, videos, audio, etc.) are the exclusive property of Preziosa s.r.l., protected by copyright, trademark registration, and other intellectual property laws. Users may use www.preziosajewelry.com only for purposes aligned with these terms. Any misuse of the site's content without prior authorization from Silvia Preziosa, the sole owner, will be legally pursued if deemed harmful to the brand image or used for plagiarism.
14. Liability
These Terms of Sale define all obligations and liabilities of Preziosa regarding product sales. Preziosa is not responsible for ensuring that products meet the user’s specific needs.
Nothing in these terms excludes or limits Preziosa’s liability for:
Death or personal injury caused intentionally or by negligence.
Deliberate damage or gross negligence by Preziosa or its employees.
Any other liability that cannot be excluded or limited by law.
Preziosa is not liable for financial losses (e.g., lost profits, revenue, contracts, or business opportunities), data loss, reputation damage, or third-party claims except as expressly stated in these terms.

User Rights:
Access: Users can request access to their personal data at any time.
Portability: Users can obtain a copy of their data in a structured, commonly used electronic format.
Rectification: Users can request corrections to incorrect or incomplete data.
Deletion: Users can request data deletion unless specific conditions apply (e.g., pending customer service issues, open orders, unpaid debts).
